Investigation Continues Into Owasso's Triple Murder

A murder investigation with three victims in Owasso has resulted in the arrest of three suspects in Tulsa. Friday, a husband, wife and 10 year old girl were shot at a home in the 9700 block of North 112th East Avenue in Owasso.

Owasso Police say with a final arrest Monday morning, they have all the suspects in custody.

old Kayla Burchett - a little girl who had just started 5th grade. She was as active as they come, playing baseball and basketball, and when she wasn't playing, she was happy to
be on the sidelines cheering for everyone else. She was that kind of girl, say her teachers, who Monday helped her classmates work through their grief.

Kayla's 3rd grade teacher Jennifer Keim: "Kayla was an exceptional, outstanding student. Her smile and spirit always filled the room." Kayla's 4th grade teacher Betty Cross: "Kayla was one of those students that every parent hopes their child is like and every teacher loves to have as a student."

up by the gangs unit of the Tulsa Police Department. He was the third suspect arrested, along with Clarence Goode and Ronald Thompson.

Goode has faced charges before - court records show convictions for drug possession
and fraud. Prosecutors dismissed charges of shooting with intent to kill and possession of a firearm and Goode is awaiting trial for assault with a dangerous weapon. All three suspects face first degree murder complaints for the death of Kayla, her mother Tara Burchett-Thompson and her husband Mitch Thompson.

Police say they know what happened and why, but aren't ready to disclose that. Owasso Police Chief Dan Yancey: "I can tell you we have established a motive for these killing and hopefully we'll be able to disclose that soon but we're got to confirm that.

Kayla's death has hit the community of Collinsville especially hard, where no one can understand the murder of such a sweet child with a bright future.

No one ever wants to receive that call.

A call from an unfamiliar number, sometimes too early in the morning. It's an unsettling feeling, deep in the pit of your stomach.

On Aug. 26, 2005 Tessa Burchett-Amaro received such a call. When she didn't recognize the number on her cell phone while at work, she didn't answer. Since the caller didn't leave a message she thought it might be a sales call. It was 9 a.m.

"For some odd reason, I thought I should call it back and find out who it was," she said.

When she did return the call, "I knew right away it was serious." Owasso police were calling on behalf of her mother to request she come to her sister's home.

It's a telephone call that will be etched in her memory forever.

It's been a year since she went to her sister's home to find a swarm of police officers and emergency vehicles.

The news was not not good. Her sister, Tara Burchett-Thompson, and her niece Kayla and Mitch Thompson had been the victims of a homicide. It was the city's first multiple homicide in 20 years.

"From Garnett, I could see through the fence and I remember seeing the worst sights ever imaginable. Ambulances, policemen, news reporters. A policeman stopped me at the street and had to get permission for me to drive to the end of the street. I got permission, but I wouldn't have needed it had it taken much longer, I knew I had to get to the end of the street. I drove as fast as I could and my mom was sitting in the front seat of a police car and told me that 'They're gone,'" said Amaro .

Just 24 hours earlier, Kayla, who had just started the fifth grade at Herald Elementary School in Collinsville, was having fun learning new moves at a tumbling class, like the back somersault she was so good at, her aunt said.

Amaro and her mom, Brenda Smalygo, took Kayla home for dinner with her cousin, Adrian Amaro, so they could spend some time together. While there, Kayla's mother, Tara called asking if she could spend the night. Though it was a school night, her grandmother, who she lived with, agreed.

Her aunt dropped Kayla off on her way home and visited her sister.

"My daughter and Kayla went inside and Kayla came out in new shoes that Tara had purchased for her. It was now 10 p.m. and my daughter had school the next day in Broken Arrow, so I knew we had to get going. I hugged my sister and told her I loved her and did the same with Kayla and patted her on the butt and got in my truck to go home," Amaro said. "I remember thinking to myself as I watched them go in the house, I should call her and remind her to put the garage door down. I forgot to call her and remind her and I will live with that guilt the rest of my life.

"Anyone can imagine how we have felt over the last year, but what I want people to know is what the world lost the day Tara and Kayla were taken from us by the hands of evil," Amaro said.

Tara was nine years younger than her older sister. And though Kayla was born when Tara was young, Amaro remembers she "was great with her from the beginning."

"Tara worked a couple of different jobs, but she loved staying home and keeping her house clean and cooking dinner and doing laundry, just like my mom had done for us. Tara hit a few rough patches, but I never saw her act negative about what life had handed her and never saw her be mean to anyone," Amaro said.

Kayla was full of life. Besides enjoying gymnastics, she played softball and basketball. She even went dove hunting with family in 2004.

"She made friends easier than anyone I've ever known," her aunt recalls.

Tara and Kayla are gone, but the family is left with many great memories.

"Our family hopes for justice in this horrible crime. That is the only thing left for us to try to accomplish now. We have to hope that the justice system works the way that it was meant to and the three evil people that did this will pay the price for the lives they took," Amaro said on behalf of the family.

"We would like to thank the Owasso Police Department, the community of Owasso and Collinsville, friends, family and everyone who has given us well-wishes, helped support the Kayla Burchett Memorial Softball Tournament, and the thoughts and prayers that we still receive," she said.,

It was just an early morning telephone call, but it changed their lives forever

One suspect in Owasso's triple homicide has been charged in Tulsa County District Court with another crime.

According to court documents, Thompson, 26, on April 11 allegedly "unlawfully, feloniously, willfully and without justifiable or excusable cause, while then and there being in the lawful custody of Tulsa County, did knowingly spit upon the person of Bryan Gaylor."

Gaylor is an employee of the Tulsa County Sheriff's Office. Hearing dates have yet to be set in the case, and Thompson remains in custody.

A second defendant in Owasso's 2005 triple murder will face the death penalty if found guilty by a jury.

During Kenneth Dominick Johnson's arraignment Wednesday in Tulsa County District Court, Assistant District Attorney Steven Kunzweiler announced that a "bill of particluars" had been filed on Johnson.

That document stated that Johnson should be punished by death because Johnson "created a great risk to more than one person" and knowingly committed murder to avoid arrest and prosecution."

Johnson, Ronald Thompson and Clarence Goode Jr. were bound over for trial on three counts of first-degree murder and one count of first-degree burglary each following a preliminary hearing in December.

The three are accused of the Aug. 26, 2005 shooting deaths of Mitch Thompson, Tara Burchett-Thompson and Kayla Burchett.

During a district court arraignment last month, Kunzweiler announced that the state would seek the death penalty should a jury find Goode guilty.

Ronald Thompson also appeared in court last month for his district court arraingment, and at that time the state announced it would not seek the death penalty in his case.

Assorted court dates have been set for the three men, including a tentative trial date of Oct. 2. Each man will face the jury separately when their cases go to trial.

Testimony in a preliminary hearing for the three men indicated Mitch Thompson had been involved in a baseball bat beating of Ronald Thompson, his cousin, which may have been a motive in the murders.

A man described by a prosecutor as an "executioner" was sentenced to death Thursday after being found guilty of committing a 2005 Owasso triple homicide. A 10-year-old girl was killed, along with her mother and the mother's husband.

Clarence Goode Jr., 31, received the punishment for all three counts of first-degree murder from the same Tulsa County jury that returned guilty verdicts against him Wednesday.

Assistant District Attorney Steve Kunzweiler told the jury Thursday that Goode deserves "no other punishment than death" after being convicted of the killings of fifth-grader Kayla Burchett; her mother, Tara Burchett-Thompson, 25; and the slain woman's husband, 28-year-old Mitch Thompson Jr.

Their bodies were found on the morning of Aug. 26, 2005, in the couple's bedroom at 9707 N. 112th East Ave. in Owasso.

Tessa Amaro, aunt of Kayla Burchett and sister of Tara Burchett-Thompson, said after Thursday's sentencing verdict "there's no celebrating today, but justice was served for our family."

Her husband, 37-year-old Mark Amaro of Broken Arrow, added "We're happy for the verdict, but we're very sad for the loss of our loved ones."

Mark Amaro invited prayers not only for his family, but for Goode's.

"We feel their pain, too," he said.

Mark Amaro commended the Owasso Police Department for its efforts on the case, which also has yielded pending first-degree murder charges against Kenneth D. Johnson, 26, and Ronald "Bunny" Thompson, 27.

The prosecution is seeking the death penalty against Johnson, who is scheduled to go to trial in February, but not against Thompson.

Thompson testified Dec. 7 that Goode threw him a .22-caliber handgun on the night of the killings and told him that "we were going to take care of business."

Assistant District Attorney Mickey Hawkins said during his portion of Thursday's closing arguments that Goode is a "a wanna-be Scarface, a wanna-be gangster" who made a choice to kill.

"Everyone paid a price as a result," Hawkins said. "Now it's time for him to pay the price."

Jim Burchett Jr., 58, of Broken Arrow testified Thursday that he vividly recalls the sense of disbelief he felt when he first heard what had happened to his granddaughter, daughter and son-in-law.

Burchett told the jury "every day and night I will be tormented. I will push on, but I'll never forget, and I'll still wonder why it all happened."

Kunzweiler said during his part of Thursday's closing that Goode placed his shots "in the fashion of an assassin" and was looking to settle a score without any thought about who might be in the way -- even a "10-year-old cheerleader."

Mitch Thompson's sister Gwen Davidson testified, "When I lost my brother, I lost my best friend. Ever since I lost my brother, I feel so alone in this world."

Co-defense attorney Stan Monroe said during his closing argument that imposing the death penalty on Goode would not erase the pain of the victims' families.

Monroe asked for life sentences -- the minimum punishments possible after Wednesday's guilty verdicts -- and told the jurors that they must not let the sentences be the product of emotion.

The defense introduced testimony Thursday from Goode's fiancee, who asked the jurors to spare his life so he could at least talk to his children as they grow up and see pictures of their lives, as well as Goode's mother.

Margaret Goode, 59, of Tulsa testified Thursday that Goode has been "all anyone could want in a son."

"I really need him," she said.

Tulsa County District Judge Tom Gillert is scheduled to impose formal sentencing Jan. 7.

Jim Burchett Jr. said after Thursday's verdict was read, "I'm just relieved."

Mark Amaro said, "I'm glad this part's over," but he noted the family will "have to relive the memories" again during Johnson's trial next year.

The Oklahoma Court of Criminal Appeals voted 4-0 last week to affirm the verdicts against Clarence Goode Jr.

Goode was found guilty of first-degree murder in the fatal shootings 10-year-old Kayla Burchett; her mother, Tara Burchett-Thompson, and Burchett-Thompsons husband, Mitch Thompson, at their home in August 2005.

Goode's co-defendant, Kenneth Johnson, was sentenced to life in prison without parole, and another co-defendant, Ronald Thompson, received life imprisonment terms in the case.

Goode's attorney, James Lockhard, said Thursday a standard appeal would be filed with the U.S. Supreme Court. Lockhard declined additional comment.
