SIOUX FALLS, S.D. (AP) - Two South Dakota State University basketball players have been indicted on charges stemming from the reported rape of a female student.

The university put out a news release Feb. 1 that campus police were investigating allegations against the men.

Results of DNA samples were sent to Brookings County State's Attorney Clyde Calhoon two weeks ago and grand jurors indicted the men Friday.

The indictment was sealed until Tuesday, when Berte and Gilbert were arraigned.

Gilbert was indicted on one count of first-degree burglary and two counts of second-degree rape. One count accuses him of having intercourse with the victim and the other alleges he forced her to perform oral sex.

Each count carries a maximum punishment of 25 years in prison and a $25,000 fine.

Berte is charged with one count of first-degree burglary, two counts of aiding and abetting second-degree rape and one count of sexual contact.

The first three counts are felonies that are each punishable by up to 25 years in prison and a $25,000 fine. The fourth count is a misdemeanor that has a maximum penalty of one year in jail and a $1,000 fine.

Both men pleaded not guilty to all counts and are scheduled to stand trial in Brookings starting Aug. 23. They were released on condition they show up to all court hearings, not have any contact with the victim and obey all laws, Calhoon said.

Fall classes at SDSU start Aug. 29.

After their suspension, both men had obtained their own protection orders against the woman, saying she made sexual advances to them. Those two orders and the one filed by the woman were dismissed last week, according to the clerk's office.

All three students remained in school through the spring semester, though the men were moved to a different residence hall to avoid contact with the woman.

Gilbert, 20, is a redshirt freshman from Brooklyn Park, Minn. He has returned home and does not plan to attend SDSU this fall.

Berte, 23, is a junior from the Ivory Coast and has remained in Brookings.

The woman is home for the summer. Sexual assault victims generally are not identified unless their claims prove to be false.

Attorneys for all three did not immediately return telephone calls Tuesday.

Michael Reger, SDSU vice president for administration, said the school would not comment because the case is now in the legal system.

"We need to let the process play out," he said.

BROOKINGS - Stories clashed on the first day of the trial of a former South Dakota State University basketball player accused of rape.

Andre Gilbert, 20, sat still and silent Tuesday as witnesses testified and a recording of his police interview played.

The first witness was the alleged victim, who forced back tears as she described the early morning hours of Dec. 15, 2005, when authorities say Gilbert entered her dorm room and raped her as his teammate Mohamed Berte, 23, watched. Both men pleaded not guilty.

Gilbert of Brooklyn Park, Minn., is charged with first-degree burglary and second- and third-degree rape.

Berte of Africa's Ivory Coast is charged with first-degree burglary and a misdemeanor count of sexual contact with a person capable of consenting who did not. His trial is scheduled for late January.

The woman said she verbally refused to do the sexual acts Berte and Gilbert allegedly asked her to perform. She said she told them "no" at least 15 times and did not yell for help or try to run because she was scared. She was alone in her dorm room that night.

"They were bigger than me, I didn't think I'd get out," she said. "I was scared of them. I didn't know what they would do if I screamed."

The alleged victim is a few inches taller than 5 feet. Berte and Gilbert are 6'8" and 6'7", respectively.

Justin Hyde, Gilbert's lawyer, said witnesses reported the alleged victim expressed attraction to Gilbert before the reported crime. The student denied this, citing race as a factor. She is white and Gilbert is black.

"I have my beliefs," she testified, "And I just believe same races go together."

In a recorded interview with an investigator that was played for the jury, Gilbert said he would not have had intercourse with the alleged victim because she was unattractive.

In the interview, he denied ever having intercourse with her and said he first heard of the reported incident through rumors when he returned from winter break.

The woman is an SDSU volleyball player and was acquainted with Gilbert because they were both athletes and "run in the same circles," she said.

State crime lab results indicate there are semen stains with DNA matching that of Gilbert's on a rug that was in the alleged victim's room at the time of the reported incident, according to investigators.

The investigation was conducted about five weeks after the incident reportedly occurred because the alleged victim did not report it until teammates confronted her in response to rumors.

Her coach then drove her to her parents' home to tell them. She then filed a report with the Brookings Police Department.

She had since washed the clothes she had worn that night.

In response to questions from Hyde, she said she was not pushed, punched or held down by Gilbert. She also said weapons were not used to threaten her, and there were no rips or tears in her clothing.

In the recorded interview, which was conducted Feb. 1, Gilbert said the accusation he faces came "out of the blue."

"I've never made an attempt to hang out with her," he said.

He said the rumors that followed him after winter break "messes up everything I worked for.

"My name is just destroyed ... for my family, for me," Gilbert said. "I was just in tears."

Gilbert also told the investigator he was with SDSU student Tracy Evans throughout the night of Dec. 14, and at first Evans confirmed that. However, Evans' cell phone records showed Gilbert had called her at least three times that night and into the early morning.

On the witness stand, Evans said she had confused the nights and realized that when she went through her text messages and saw Gilbert had messaged her on the night in question.

Evans said when she realized her mistake, she told Gilbert, and Gilbert told her to tell the police.

The trial is expected to continue through Thursday or Friday.

Gilbert returned to Minnesota after the spring semester, and Berte remains on campus. Both were suspended from the basketball team.
