JACKSON, Tenn. -- Because a Jackson man was sent to prison on a sexual assault conviction, he has been charged in another case from when he was a teenager.

Jackson police said they have charged 20-year-old Darius Amontee Cole with the rape of a 5-year-old girl in November 2002.

The Jackson Sun reported the arrest came after Cole was put into prison in a separate s
exual assault case and DNA was collected from him under state statute.

The sample was run through a TBI database and matched DNA collected when the child was raped.

Police said the victim was playing outside when a stranger took her behind a chair on a front porch, raped her and fled.

Cole is serving his current sentence at the Northwest Correctional Complex in Tiptonville.

The man accused of raping a 5-year-old girl more than six years ago apologized to the victim during his court appearance in Madison County Juvenile Court on Wednesday morning.

Darius Amontee Cole, 20, was charged with rape of a child last month after DNA evidence matched him to the rape.Cole is serving a 10-year prison sentence at the Northwest Correctional Complex in Tiptonville for another sexual assault that occurred in 2004. He was transferred to adult court in that case and pleaded guilty.

Authorities were able to match a DNA
sample taken from him in prison to DNA from the child rape case.
Cole was 13 when the first rape case happened in November 2002, which is why the case is in juvenile court.

"I humbly apologize to my victim," Cole said after Judge Christy Little read the charges against him. "I am not the same Darius Cole; I learned from my mistakes."

The victim did not testify in court, and it is not known whether she was there. She is now 12 years old.

Little said Cole's case was unique and required legal research to decide how to handle it.

Generally, after a person is transferred to adult court, he remains in adult court, Little said. But because this incident happened before he was transferred, it still fell under juvenile court's jurisdiction.

Cole also will undergo a mental evaluation before a probable cause and transfer hearing is held in juvenile court.
That hearing is set for 9 a.m. Aug. 12.

Cole asked Little whether the statute of limitations would apply to his case. Little said she did not th
ink so, but his lawyer would need to check that.

According to Tennessee state law, rape of a child is a Class A felony, and the statute of limitations is 15 years.

Jackson police have said the 5-year-old girl was playing outside at a neighbor's house when a stranger walking down the street approached her. He then took her behind a chair on the front porch, raped her and fled.

She was taken to a local hospital where medical personnel completed a standard sexual assault evidence collection kit.
The girl only was able to provide a general description of the man, police have said.

Cole asked Little whether the statute of limitations would apply to his case. Little said she did not think so, but his lawyer would need to check that.

This nigger clearly believed his case could not be prosecuted for lack of jurisdiction under the Statute of Limitations and this is probably the only reason he apologized for the child rape (as if that were even possible). Of course, an apology in open court is an admission of guilt, and any prosecutor worth a paperbag will be able to obtain a guilty plea out of the nigger. But because he is not the same person and he learned from his mistakes:

"I am not the same Darius Cole; I learned from my mistakes."
