But Hubert and Agnes Bledniak's daughter, who has been in the U.S. since she was 2 years old, faces getting thrown out of America if she doesn't "voluntarily leave" the country by July 23. If she doesn't go "home" to Poland — a country she hasn't seen since she was a baby — on her own, she'll be sent back involuntarily and not allowed to return for 10 years. Ewelina's family came to America in 1999, and her father has become an American citizen. Her mother, a permanent resident, also is seeking to become a citizen. But because of a lawyer's mi stake eight years ago, according to the Bledniaks, Ewelina can't stay in the U.S. with her parents. Continues. HUNTINGTON BEACH A custody battle over an 11-year-old Mexican girl who lives in Surf City should take place on U.S. soil even though she, her mother and father are in the country illegally, a federal appeals court has ruled. A panel of judges at the U.S. 9th Circuit Court of Appeals ruled Wednesday that the girl should be allowed to stay in the U.S. during the international custody proceedings because she is "well settled" in her new country and that her legal status should not come into play. The ruling set the first precedent of its kind when it comes to the interpretation of the Hague Convention, to which both countries belong. The international accord is designed to protect children involved in cross-border custody disputes, establishing whether a child should be returned to a country for custody proceedings. The appellate court's decision overruled a judgment by the U.S. District Court in Santa Ana that would have sent the girl back to live with her father in Acapulco because of the girl's undocumented status.

You're right! She doesn't bring good diversity to the table. Maybe if this sweet girl was transgendered they would let her stay. Where's the ACLU and John McCain on this one????
