Brandenburg v. Ohio


Facts of the Case:

Brandenburg, a leader in the Ku Klux Klan, made a speech at a Klan rally and was later convicted under an Ohio criminal syndical
ism law. The law made illegal advocating "crime, sabotage, violence, or unlawful methods of terrorism as a means of accomplishing industrial or political reform," as well as assembling "with any society, group, or assemblage of persons formed to teach or advocate the doctrines of criminal syndicalism."

Question:

Did Ohio's criminal syndicalism law, prohibiting public speech that advocates various illegal activities, violate Brandenburg's right to free speech as protected by the First and Fourteenth Amendments?

Conclusion:

The Court's Per Curiam opinion held that the Ohio law violated Brandenburg's right to free speech. The Court used a two-pronged test to evaluate speech acts: (1) speech can be prohibited if it is "directed at inciting or producing imminent lawless action" and (2) it is "likely to incite or produce such action." The criminal syndicalism act made illegal the advocacy and teaching of doctrines while ignori
ng whether or not that advocacy and teaching would actually incite imminent lawless action. The failure to make this distinction rendered the law overly broad and in violation of the Constitution.

Hal Turner has been arrested...

North Bergen, NJ (TRN) -- At about 4:00 this afternoon, Hal received a call from the North Bergen Police telling him to go to the Police Station because they had received a tip from a credible source about a death threat made against him and they needed to talk. He arrived at the station at about 4:10 and was arrested at 4:15. It seems that the state of Connecticut issued a warrant for his arrest for making "Harassing Communications". There is no other information available at this time. At this point, any and all donations toward his defense would be greatly appreciated.

Quite obviously, the Hal Turner Show will not air tonight. All other shows will run as scheduled.

Federal state and local cops have surrounded my house around 9:54 this morning and a heavy police presence remains to this minute.

According to my lawyer, he checked with his inside sources at the US Courthouse in Newark and found out the following:

The United States Attorney for the District of New Jersey is awaiting a vote by a federal Grand Jury on his effort to indict me for advocating the overthrow of the US Government, advocating the assassination of Congress and for publishing a plan for doing so.

State Capitol Police Arrest New Jersey Blogger

Connecticut State Capitol Police say they have obtained an arrest warrant for a New Jersey man in connection with an incident at the State Capitol on Tuesday. The warrant charges Harold "Hal" Turner, 47, of North Bergen, New Jersey with inciting injury to persons or property.

Capitol Police, with the help of the North Bergen, N.J. Police Department arrested Turner late Wednesday afternoon without incident. Turner is due to be presented in court in New Jersey on Thursday for extradition to face charges in Connecticut.

Police say they began investigating after becoming aware of an internet blog authored and controlled by Turner that contained language that incited its readers to take up arms to deal with the co-chair
s of the legislature's Judiciary Committee, Rep. Michael Lawlor and Sen. Andrew McDonald, and an employee of the State Ethics Commission. Turner also made a threatening comment in regards to any state's attorney, police department, or court that attempts to deal with this matter, police said.

Turner's comments on his blog followed an overview of the events surrounding Senate Bill 1098, which would have changed the way the Roman Catholic Church governs itself.

“Mr. Turner’s comments are above and beyond the threshold of free speech," said State Capitol Police Chief Michael Fallon. "He is inciting others through his web site to commit acts of violence and has created fear and alarm. He should be held accountable for his conduct,”� said Fallon.

It is not clear when Turner will be extradited to Connecticut to be officially charged, police said.

N.J. man charged in threats against legislators

A New Jersey man with ties to white-supremacist and neo-Nazi organizations was arrested on felony charges Wednesday after his Web log suggested that two Connecticut lawmakers and a state ethics officer should be shot.

Harold Charles Turner, of North Bergen, also known as Hal Turner, was arrested by State Capitol Police for inciting injury.

The arrest came the day after his blog alluded to using guns against Sen. Andrew J. McDonald, D-Stamford, and Rep. Michael P. Lawlor, D-East Haven, co-chairmen of the Judiciary Committee, and Thomas K. Jones, enforcement officer for the Office of State Ethics.

Turner, 47, was booked in New Jersey, pending extradition to Connecticut.

What got Hal Turner in trouble? Threats on his Web site commentary

If you were wondering what spurred Connecticut authorities to issue an arrest warrant for white supremacist and hate-radio talk show host Hal Turner of North Bergen, it can be found on his Web site.

Apparently, Turner, as he often does, was advocating violence against a Connecticut state assenmblyman and state senator; and he went on to say that if the authorities got involved they too would be in danger.

Connecticut officials want to extradite him to their state. A North Bergen spokesman said Turner is currently at Hudson County jail.

This is a direct government assault upon the Catholic Church, in absolute violation of the First Amendment to the Constitution for the United States.

It is very clear to us at the Turner Radio Network that the state of Connecticut has become tyrannical and abusive. It is actively and aggressively attempting to directly interfere with the internal governance of a church and the free exercise of religion. It is retaliating against citizens for exercising their right to petition for redress of grievances. This is tyranny and it must be put down.

While filing a lawsuit is quaint and the "decent" way to handle things, we at TRN believe that being decent to a group of tyrannical scumbags is the wrong approach. It's too soft.

An additional charge has been added against Turner, making it two thus far. One can only wonder how many more will be tacked on in the days to come by hungry and desperate prosecutors seeking to appease big-wig and out of control politicians. Politicians and government officials who now will seek to silence and bankrupt Turner. Turner may have went too far this time. Keeping fingers crossed - it doesn’t look good.

ued wasn't just for the charge of "Harassing Communications." It was a "Fugitive from Justice" warrant. The state of Connecticut claims that they allegedly contacted Mr. Turner and asked him to turn himself in (no such request was made). When he didn't follow through with this alleged request (because no such request was made), they issued the "Fugitive from Justice" warrant, which called for the North Bergen Police to arrest him on the charge of "Harassing Communications". That is all the information we have at this time.

Outraged over state's "attack" of the Catholic Church

A New Jersey blogger and talk show host is getting the attention most folks who do what he does would love. Unfortunately, it's not positive attention. He called upon his readers to threaten two Connecticut lawmakers and a state ethics office employee.

Harold "Hal" Turner, 47, was angry about controversial legislation on Catholic parish finances and incited his blog readers "to take up arms" against Connecticut Sen. Andrew McDonald and State Rep. Michael Lawlor, both well-known fag supporters.

Turner has been referred to as a "shock blogger" in news reports.

According to
his Web site, he planned on Wednesday to "talk about the attack by the State of Connecticut against the Catholic Church, and I'll give out some home address info for some State Officials."

“This is a direct government assault upon the Catholic Church, in absolute violation of the First Amendment to the Constitution for the United States,”� Turner posted on his blog.

Capitol Police obtained an arrest warrant charging Turner with inciting injury to persons or property. Police in North Bergen, N.J. took Turner into custody Wednesday and he is scheduled to appear in court there Thursday for extradition to face the charges in Connecticut.

Turner posted a colorful commentary on his Website about the whole church bill situation:
