Because Cyril Byrd wanted to party like it was 1999 - which was literally hours away - he rented two limos to take his crew to a Roselawn club for a New Year's Eve party.


Byrd then decked himself out in a nice suit topped off by his black mink coat and went to Club Oasis on Seymour Avenue for the Dec. 31, 1998, party to ring in the new year.

Before he left, shots were fired, a club security guard was dead and Byrd went on the run for what proved to be nine years.


All of this happened "because (Byrd) thought someone took his fur coat," Assistant Hamilton County Prosecutor Linda Calambas said Thursday.

Byrd, now 35, is on trial before Common Pleas Judge Melba Marsh. He is charged with murder in the Jan. 1, 1999, killing of Jerry Gilbert, a security guard on duty for the club's New Year's Eve party.



Byrd's defense, in a trial held without a jury, is that someone else fired the shot that hit Gilbert in the chest and killed him.

At the party, Byrd complained to club management that his mink coat had been stolen. He pointed out to them a woman wearing a fur he believed was his. When Byrd tried to question the woman, friends from both sides quickly gathered, someone threw a punch and a melee erupted.

Club bouncer Robert Lovett testified Thursday he and other security workers quickly separated the two factions, pushing one group - that included Byrd - outside.

Moments later, Lovett saw Byrd re-enter the club - with a gun.

"He just turned and fired the gun and everybody scattered," Lovett testified.

Unknown to Lovett at the time, one of the shots hit Gilbert, 50, of Milford.

"When I went past Jerry, I saw he was kind of leaning. ... I thought he was moving out of the way," Lovett said.

Lovett then saw an irate Byrd fire more shots into the ceiling. He turned to see Gilbert on the floor. He raced to start lifesaving efforts.

Lovett said Gilbert was shot minutes after the pair was discussing Gilbert not having a bullet-proof vest.

"As a matter of fact, that was the last conversation that we had," Lovett said.

Police quickly identified Byrd as the prime suspect. One of those who rode in the limo with Byrd that night told police he saw Byrd show a gun that was in the limo's glove box.

When police searched Byrd's Covington home, they found three handguns and ammunition - but not Byrd.

They wouldn't find him until September 2007, when the FBI arrested him in Chandler, Ariz., after Gilbert's killing was featured on the television show "America's Most Wanted" and a viewer called in a tip.

When Byrd was arrested, he had a gun, $15,000 in cash and a Pennsylvania driver's license in the name of Nasir Romair Lomax. That was one of several aliases Byrd told police he used.

He'd been arrested earlier in Phoenix under another name but was released before his true identity became known to police. In that case, Byrd told police, Phoenix police seized $25,000 and he never tried to get the money back for fear of them learning of the Cincinnati charges.

Court records do not indicate how Byrd earned his living.

Byrd also told police he never got the mink coat back, either.

Judge frees defendant in 'mink murder'

It took Cincinnati police nine years to find Cyril Byrd and charge him with murder.


It took a judge less than nine minutes today to set Byrd free, declaring him not guilty after Byrd’s defense team frustrated witnesses and their nine-year-old recollections.

Hamilton County Common Pleas Judge Melba Marsh heard four days of testimony in the case – without a jury – before rending her verdict minutes after the sides concluded their cases.

The judge was struck by how different the prosecuting witnesses’ testimony was in 1999, when security guard Jerry Gilbert was gunned down, and in the past week.

“They’re statements were just totally different from (nine) years ago and the defense was able to destroy that,”� Marsh said.

Byrd, 35, went to a Dec. 31, 1998, New Year’s Eve party at Club Oasis in Roselawn.

When his mink coat disappeared at the party, an irate Byrd confronted a group – that included then-University of Cincinnati basketball player Art Long – about it.
Tempers flared, punches were thrown and, minutes later, shots were fired.

Security guard Jerry Gilbert was shot in the chest and died. Byrd disappeared and was arrested in 2007 in Chandler, Ariz., where he had at least two other aliases and had been arrested at least once.

Several witnesses testified during the trial that they saw the shooting, Byrd or some of the fight, but the differing testimonies rarely agreed.

“Of all of the witnesses who testified, no two were the same,”� Marsh said. “None of the witnesses could remember their (1999) testimony.”�

The judge was so flummoxed by the differences in testimony that she drew up charts that, depending on the witness, had Byrd in different color outfits, different styles of dress and different locations in the club.

Then, when Cyril Hall, the Michigan attorney who represented Byrd, started questioning witnesses about their recollections from nine years ago, Marsh was stunned at their inconsistencies. One witness was so frustrated by Hall’s questioning, he accused the attorney of “trying to humiliate me.”�

Prosecutors argued that Byrd’s disappearance for nine years showed his guilt.
“If he was the killer – and I stress ‘if’ – did he benefit from being gone years? I’d say yes,”� Marsh said.

Now, Byrd is heavier, is bald and looks little like when he was age 26 at the time of the shooting.

“He just looks remarkably different,”� the judge said.

The decision left Gilbert’s family, who attended the entire trial, numb and in tears. They left the courtroom stunned, unwilling to talk.

This isn't a huge amount of money like some, it is the south outside of Atlanta after all, but monthly dues keeps niggers away. Not a single nigger member and this all without official segregation.

I've never seen a groid employee either.

Really pretty nice, think about it.

$200 a month gets you all the golf you can play plus a dining room serving some of the best food in town all without having to lay eyes on a single groid while eating not to mention the peace of mind you get knowing a set of filthy monkey paws never touched your food out back.

I will not eat groid tainted food which is why I avoid all restaurants except the country club and an Italian restaurant I know.
