Rapist should have been behind bars Baldwin Ndaba May 07 2008 at 07:40AM The man convicted on two counts of raping a 14-year-old US girl should have been in jail when he violated her. The astonishing revelation came minutes after Johannesburg High Court Judge George Maluleke convicted self-confessed rapist and robber Stanley Tirizai Mabona, 21, of Pimville, Soweto, on two counts of raping the girl on June 20. The girl had been in South Africa for three days with her mother and other Americans for an HIV/Aids training project. Judge Maluleke also convicted Mabona on two counts of robbery with aggravating circumstances, illegal possession of an object which resembles a firearm, and pointing that object at his victim with the intention to rob. After the conviction, prosecutor Xoli Khanyile stood up in court and read out Mabona's previous convictions. Advocate Khanyile said Mabona's first brush with the law had been in November 2005 when he was arrested for common assault. He was found guilty on January 12, 2006, and sentenced to a fine of R1 000 or 60 days in jail, conditionally suspended for five years. A month later, on February 24, he was charged with assault with intent to do grievous bodily harm. He was convicted and was fined R2 000 or 60 days in jail. He was also declared unfit to possess a firearm. The sentence was again conditionally suspended for five years. On January 30 last year Mabona was again convicted of common assault. His fine of R3 000 or six months in jail was again suspended. On Tuesday, the prosecution was unable to explain why these suspended sentences had never been enforced. Mabona had admitted to accosting the girl, her mother and their five friends in a bid for a lighter sentence. The state refused to accept this. The case was postponed to May 30 for sentencing. |

US teen's rapist locked up
A Johannesburg High Court judge on Friday said Stanley Tirizai Mabona, 22, of Pimville, Soweto, had shamed his country - and then sentenced him to an effective 18 years in jail for the multiple rape and robbery of a 14-year-old American girl. The girl was in the country for only three days with her mother and other Americans to teach about the dangers of HIV and Aids when Mabona kidnapped her from a group of friends on June 20 last year. They were returning from a party that night when Mabona and his friend Derrick Mabaso pounced. Mabaso later turned state witness. Mabona, who was carrying an object resembling a firearm, then took the girl to a disused golf course in Pimville where he raped her. Afterwar ds, he took her to his family's house where he raped her again in the presence of his retarded brother. He was found guilty on May 6 of two rapes, two robberies, kidnapping and illegal possession of an object resembling a firearm. On Friday, he was sentenced to 18 years imprisonment for the rapes, 10 years for the robberies, four years for kidnapping and three years for illegal possession of the object and pointing it at his victim. All sentences will be served concurrently. Judge George Maluleke said Mabona had admitted guilt in one rape and robbery. "He also told his friend the next day that he regretted his decision to rape the girl. He also made the same remark to the probation officer, and that showed a measure of consistency," Judge Maluleke said. Prosecutor Xoli Khanyile had asked for life sentences on both counts of rape. |
