Once again, sounds like nigger names linked to the killing of a white girl.

Birmingham police have arrested three men and charged them with capital murder in connection with the death of UAB student Kayla Fanaei who was slain in October during a robbery near the campus.

Police arrested Alfred Jerrell Marina and Maurice McCarty, both 19, on Thursday at their residence at 324 73rd Street North.

Gregory Hill, 21, was arrested today, said Birmingham Police Chief A.C. Roper.

Names of the three men surfaced earlier this week as police investigated other area robberies. "This was literally a nonstop case for us," Roper said during a press conference this afternoon. "We believe we have the right people."

Police would not say who pulled the trigger.

Fanaei was found dead about 1 a.m. Oct. 8 in the driver's seat of her convertible BMW in the parking lot of Glen Iris Elementary School. She had just left a surprise birthday party about five block from where she was killed.

Three three are being held without bond in the Jefferson County Jail.

Other than traffic offenses none of the men had prior records, police said.

I can't stand seeing such a beautiful and promising young lady's life snuffed out by worthless animals like this....such a ****ing tragedy...they should all by thrown into a huge cage and lowered into the Gulf of Mexico an inch a day until they have renounced all violence and are pleading for forgiveness.
Then with their heads bobbing slightly above the water and you are sure that they will never, ever harm another human being.....Cut the ****ing rope and let them sink slowly to the bottom....problem solved!

My grandfather was the prosecutor in Birmingham long ago. In those days, the death penalty was in order if a burglar had a gun on him when he broke into a house, even if hadn't shot anyone.

Times have certainly changed. I now live in New Jersey, where the death penalty has just been banned, not that it ever would have been applied anyway, with our ultra-liberal supreme court. When seat belt Jon Corzine signs the bill, Jesse Timmendequas can officially celebrate.

For those who don't know who Jesse Timmendequas is, he's the convicted child molester who was released into a suburban neighborhood without any warning to the residents. He soon lured Megan Kanka into his house, knocked her out, raped her, killed her, took her body into the woods, raped the corpse, and left.

"Megan's Law" was created as a result.

Timmendequas was sentenced to death, but New Jersey liberals came to his rescue.

Second mistrial declared in case of man charged with killing UAB student

A Jefferson County Judge today declared a mistrial in the retrial of Maurice McCarty, accused in the 2007 shooting death of University of Alabama at Birmingham student Kayla Fanaei.

The mistrial was declared by Judge Teresa Pulliam after a witness in the case repeated on the stand something a co-defendant had said about the defendant's guilt.

Pulliam said another trial date will be set for some time before summer.

This is the second mistrial in the case.

In September, a jury could not decide if McCarty, 21, was guilty of either capital murder or the lesser offense of felony murder, or if he was not guilty.

Jefferson County prosecutors contend that McCarty was the person who shot Fanaei on the parking lot of Glen Iris Elementary School. Co-defendant Gregory Hill has pleaded guilty to a lesser charge. A third co-defendant, Alfred Marina, also faces a capital murder charge in the case.
