Penn State RB Did Not Play Against Iowa

STATE COLLEGE, Pa. -- Sources close to the Penn State football team have confirmed to Channel 6 that the locker of Penn State running back Austin Scott has been cleared. The university said Saturday he did not play against Iowa due to violation of team rules.

Penn State head coach Joe Paterno said after Saturday's game Scott's status as far as playing "is in doubt." Channel 6 News reporter Gary Sinderson was told Saturday afternoon Scott returned to his home in Allentown, PA.

On Friday, Channel 6 learned from Penn State police they were investigating an on-campus sexual assault which occurred early Friday morning. A woman said she was assaulted by a Penn State football player. Channel 6 learned the player under investigation was a starter on offense. Police have not said whether or not Austin Scott was involved in the alleged assault.

Penn State police also say alcohol played a factor in the alleged assault, which reportedly took place in the Nittany-Pollock dorms on campus. Police are not releasing the player's name while they continue to investigate.

STATE COLLEGE, Pa. -- Suspended Penn State running back Austin Scott has been charged with raping a woman at his on-campus apartment after meeting her at a bar.



Scott, 22, was arraigned Friday on charges of rape, sexual assault and two counts of aggravated indecent assault, all felonies, in connection with the Oct. 5 encounter.

Scott declined to comment as he left the courtroom Friday.

"The interaction he had with the woman involved was coonsensual , and we anticipate we will be able to prove that in court," his lawyer, Joseph Amendola, said. "Very optimistic. We're looking forward to the opportunity of establishing his innocence."

Authorities said the encounter occurred in the early morning hours of Oct. 5. Coach Joe Paterno suspended Scott later that day, saying the tailback had violated an unspecified team rule.

Scott remains enrolled at Penn State.

"As with the case with any sexual assault, we consider it a matter adjudicated by the court, and we can't get into details at this point," university spokeswoman Lisa Powers said.

Scott also faces three misdemeanors: two counts of indecent assault and one count of simple assault. He was released on $50,000 unsecured bail and ordered to stay away from the alleged victim.

Scott remains on the roster but is still suspended, team spokesman Jeff Nelson said Friday.

"As coach Paterno stated earlier this week, he has not participated with the team since the end of last week and we do not have any further comment at this point," Nelson said.

A preliminary hearing was scheduled for Wednesday.

Penn State's Scott Charged with Rape

STATE COLLEGE, Pa. (AP) - October 12, 2007 - Suspended Penn State running back Austin Scott has been accused of raping a woman at his on-campus apartment after meeting up with her at a bar.

Scott, 22, was arraigned Friday on charges of rape, sexual assault and two counts of aggravated indecent assault, all felonies, in connection with the Oct. 5 encounter.

According to court documents, Scott acknowledged that the woman did not initially want to have sex. Investigators, paraphrasing Scott's statement, wrote that Scott said, "Girls will say that they do not want to have sex, but then they get to your room, things heated up and they change their mind."

The woman told police that she was scared and "went along with it because she was afraid defendant was going to hurt her," according to court documents.

Scott declined to comment as he left the courtroom Friday.

Authorities gave the following account in a criminal complaint: Scott said he had known the woman for about two months, but did not know her well.

The two met a downtown bar after exchanging text messages. The woman said she had a few drinks that night, and Scott said he finished the woman's drink before they left the bar at 1:30 a.m.

The woman told Scott at the bar and during the walk to his apartment that she did not want to have sex. (That's foreplay to a nigger.)

After she fell asleep on a bed, the woman said she was awakened by Scott trying to have sex with her, that Scott held her down and that he pulled and twisted her arm. She said she felt a punch to her back during the encounter.

After the woman left the apartment, she called a friend, who called police at 4:15 a.m.

Scott cooperated with police. Scott did not know the woman's name or address, and referred to her as "this girl" in discussing the encounter.

Scott told authorities he believed that (by nigger standards) the sex was coonsensual.

When asked by police, Scott said, "Yeah, she said she did not want to have sex." He then, explained, according to the authorities' paraphrasing of the statement, "Girls will say that they do not want to have sex, but then they get to your room, things heated up and they change their mind."

Scott, a fifth-year senior, ran for 302 yards and six touchdowns this season before his suspension last week. He arrived at Penn State in 2003 a highly touted recruit after setting state records of 3,853 rushing yards and 53 touchdowns as a senior at Parkland High School in Allentown.

He led Penn State in rushing his freshman year (436 yards), but nagging injuries and other off-field issues kept him lagging on the depth chart. He redshirted last season after being slowed by an ankle injury.

The 22-year-old woman
testified that she had known Scott for two months before the alleged attack at his on-campus apartment. The woman also said that she said "no" once before Scott punched her near her kidney, at which point she became submissive.

STATE COLLEGE, Pa. -- A rape charge and all other criminal charges against former Penn State running back Austin Scott were dropped Friday.

The decision came after the state Superior Court ruled earlier Friday that jurors could hear testimony about the alleged victim's involvement in a separate sexual assault case in 2003. The defendant in that case was acquitted.

"I'm ecstatic about the charges being dropped," Scott told a news conference Friday night. "I'm not going to lie -- I'm a little bitter toward the district attorney. I'm just going to take it every day one day at a time and just try to rebuild what I had."

The Centre County district attorney's office said in a statement it withdrew the charges because there was "no reasonable likelihood" it could meet the burden of proof.

"It is with deep regret that we ... withdraw the charges against Austin Scott," the statement said.

Scott's agent said six NFL teams had called about his client after hearing the news, NBC 10 reported.

"In the last hour and a half, we've talked to six teams specifically about his eligibility and his availability," Scott's agent said at the Friday night news conference. "Including, sending to most of these teams, the actual court documents. That's how far they wanted to know what was going on with him."

Scott said he has no preference about what team he would like to play for. Scott's attorney said they were considering a lawsuit against the prosecutor, NBC 10 reported.

Scott left for his home in Allentown on Friday.

"Finally, justice," defense attorney John Karoly said in a phone interview from his Allentown office.

Karoly said Scott was "happy and troubled" when the running back heard the news, and that Scott questioned why the case started in the first place when prosecutors were aware of the previous case.

Scott, 23, never played for Penn State again after Paterno suspended him on Oct. 5, citing a violation of team rules. Police charged Scott a week later.

A team spokesman declined comment on Friday's development.

On Tuesday, the day before the trial was to begin, prosecutors appealed Centre County Judge Thomas Kistler's ruling allowing evidence of the woman's involvement in the earlier case to be heard.

The woman in the earlier trial "admitted, under oath; to lying about the sexual intercourse being forced and stated that it that was, in fact, consensual for several hours," Kistler wrote in one order.

The state Superior Court sided with the defense in allowing the evidence.

"The facts of the case have not changed from the time he was arrested," said the statement from the district attorney's office. "However, the trial judge has ruled evidence of the victim's past is relevant to this case though it has always been our position that the evidence of the victim's past is irrelevant."

Karoly said Scott was offered a plea bargain after the appeals court ruled but declined and was confident he would be acquitted at trial.

The case, Karoly said, was pursued with "unusual vigor" by assistant district attorney Lance Marshall, who had also prosecuted former Penn State defensive tackle Scott Paxson on indecent assault charges in Sept. 2006. Paxson ended up pleading no contest to disorderly conduct as part of a plea bargain.

Marshall disagreed. "We've had so many successful prosecutions of rape and sexual assault. These are just tough cases," he said. "Paxson and Austin Scott have nothing to do with each other."

Scott arrived at Penn State in 2003 after having set state scholastic records the previous year for most single-season rushing yards (3,853) and touchdowns (53) at Parkland High School

But his career at Penn State was set back, in part, by injuries, and other, lesser off-field issues that didn't please Paterno. He had 302 yards and six touchdowns on 69 carries in five games last season before being suspended for the remainder of his senior season.

Scott has said that he hopes to be drafted by an NFL team, or eventually play pro football. The recreation, park and tourism management major is still enrolled as a student and is scheduled to graduate next month.
