Police: DNA Hit Leads To Charges In 1999 Rape

KANSAS CITY, Mo. -- Jackson County prosecutors charged a Kansas City man on Wednesday in the 1999 rape of an 81-year-old woman on Christmas Eve.

Terry U. Birmingham, 41, is charged with three counts of forcible rape, first-degree burglary, first-degree assault and second-degree robbery.

Police said an 81-year-old woman had just delivered Christmas cookies to a neighbor when a man followed her and forced his way into the woman's home in the 4700 block of Jarboe Street.

The woman told police the man demanded money from her, which she gave him. She said THE NIGGER then demanded more money and forced her into a bedroom where she was raped several times. Police said the woman was also beaten.

Investigators said the woman was taken to a hospital for a rape examination, where police collected DNA.

Prosecutors said the DNA was later matched to Birmingham.

Terry Birmingham KANSAS CITY, Mo. – A man currently in prison in Farmington has been charged with a 1999 rape of an 81-year-old woman.

Jackson County Prosecutor Jim Kanatzar charged Terry U. Birmingham, 41, with three counts of forcible rape, first degree burglary, first degree assault and second degree robbery. The charges stem from the Christmas Eve 1999 attack on an 81-year-old woman who was returning to her residence in the 4700 block of Jarboe after delivering Christmas cookies to a neighbor.

The case was the first one the Jackson County Prosecutors Office filed as a "John Doe" case, meaning that the charge was based on the defendant's DNA profile. Filing such a case as a John Doe essentially stops the clock on the statute of limitations to charge someone with a specific crime. The case is also significant because it helped lead the state legislature to eliminate the statute of limitations in rape cases several years later.

According to court documents, Birmingham is alleged to have followed the victim home and forced his way inside the residence. Once inside, he reportedly demanded money and, when he was unhappy with the money the victim gave him, demanded more cash and forced her into a bedroom where he raped her several times. The victim was also struck in the face repeatedly before leaving the residence with an estimated $225 in cash.

An examination at a hospital provided police and prosecutors with the DNA and genetic profile which was later matched to Birmingham. Prosecutors have requested no bond in the case.

KANSAS CITY, Mo. -- A Kansas City man has been convicted of raping an 81-year-old woman a decade ago, even though the victim hasn't been seen since 2004.

A Jackson County jury found 43-year-old Terry Birmingham guilty of forcible rape, assault and burglary on Thursday.

Prosecutors filed the charges against an unknown "John Doe" in 2002, using the DNA profile from evidence taken from the victim, Carol Cooper.

The case prompted the Missouri Legislature to change state law to exempt forcible rape and sodomy from a three-year statute of limitations.

Cooper told police after the attack that someone followed her into her home on Christmas Eve 1999 after she took Christmas cookies to a neighbor.

She disappeared in 2004 after leaving home for a walk. (I trust the donut eating cops will take a long look at the nigger for her missing from 2004 as well. I would bet the nigger went back and killed her and disposed of her body to protect himself from being identified!! Either way, this nigger should be hung immediately!!)
