Hubert Thompson is now charged with first-degree murder. He's accused of throwing a neighbor from a third-floor balcony.

Officers responding to a disturbance call yesterday say they found the 66-year-old victim sprawled on the pavement at an apartment complex in Lombard. The man was later pronounced dead.

Police say the 28-year-old Thompson surrendered last night after nearly seven hours holed up in his apartment, after SWAT teams had surrounded the building.

Thompson was named the Spartans' most-improved player during the 1999 season.

James Malone, 66, loved to sing but kept pretty much to himself in an apartment building in Lombard, a neighbor said.

Hubert D. Thompson, 28, was a 6-foot-3-inch, 270-pound former professional football player who lived in the same building in the 1100 block of Finley Road.

For reasons that remained unclear Saturday, Thompson hurled Malone over a balcony Friday afternoon, killing him, police said. Thompson was charged with first-degree murder and was being held in lieu of $3 million bail.

Authorities said the incident unfolded about 1:45 p.m., when Thompson, who also played football at Michigan State University, confronted Malone in a third-floor hallway. Thompson punched his neighbor in the face, then threw him over a balcony, said Lombard Police Deputy Chief Dane Cuny.

Investigators don't know what triggered the attack, he said.

"It may have been a situation where the victim was at the wrong place at the wrong time," Cuny said. "The offender may have been going through some sort of emotional episode."

He said officers have had contact with Thompson on several occasions related to "emotional issues," all of which ended peacefully.

Antoinette Hummel, who lives in the apartment below Malone's, said the men knew each other but never had any previous run-ins that she was aware of. She said Malone was an active member of his church choir, and she often could hear him singing in his apartment.

"Everything's so overwhelming, because he was a timid person who would never say a mean word to anyone," Hummel said.

When police arrived, they found Malone lying in the first-floor lobby. He was taken to a hospital and was later pronounced dead.

Thompson locked himself in a relative's apartment and refused to communicate with police, authorities said. At 9 p.m., after getting a search warrant, a SWAT team entered the apartment and Thompson surrendered without resistance, Cuny said.

Thompson was a standout football player at Proviso West High School in Hillside and played defensive end at Michigan State. In 2000, he was signed by the New Orleans Saints but was cut after two days of practice for fighting with a teammate over an exercise bike, according to a published report.

A former football standout with failed NFL aspirations was ordered held on a $3 million bond this morning on suspicion he threw his neighbor to his death from a third-floor balcony in their Lombard apartment building.

Prosecutors charged Hubert Thompson, 28, with first-degree murder late last night after a seven-hour standoff in the Finley Place apartments on the village’s southwest side.

Authorities confirmed 66-year-old James Malone died after being tossed from the third-floor balcony. He was pronounced dead at Advocate Good Samaritan Hospital in Downers Grove.

Thompson spent the night at the Lombard police station. He was booked into the DuPage County jail this morning after the brief bond hearing.

Dressed in an orange jail jumpsuit, the 6 foot, 5 inch man was surrounded by about one dozen sheriff’s deputies who lined the courtroom. Thompson kept his handcuffed hands clasped in front of him and answered a few perfunctory questions about his job status.

DuPage Associate Judge John Demling, who set the $3 million bond, also appointed an assistant public defender to represent the unemployed man.

It’s unclear what, if anything, prompted the attack. Authorities said Thompson admitted to police during questioning that he punched Malone in the head after encountering him in their hallway and threw him to his death three stories below.

DuPage County State’s Attorney Joseph Birkett said the defendant’s mental health will be examined.

“The allegation is that it was unprovoked,”�”� Birkett said late Friday. “This individual is going to be evaluated, I’m sure.”�”�

The melee began about 1:45 p.m. Friday when neighbors called police to the apartment complex on the 1100 block of South Finley Road to report a severely injured man sprawled out on the pavement.

By that time, Thompson had retreated into the apartment he shares with his mother. Police said he was alone during the standoff and did not have a firearm.

Police quickly evacuated neighbors. A team of SWAT members descended upon the building and cordoned off the area. At least a dozen police squads surrounded the building at Finley Road and Morris Avenue just north of Roosevelt Road.

Members of Thompson’s family, including his mother and siblings, also waited outside. Nearly seven hours later, Deputy Police Chief Dane Cuny confirmed the man had surrendered peacefully about 8:40 p.m. Friday after talking to a police negotiator.

His criminal history includes arrests for two alleged domestic batteries, criminal trespass to land and, in 2001, attempted armed robbery and aggravated assault in DeKalb. The DeKalb charges were dismissed.

Several residents said they heard a commotion on the third floor of the building, including a scream and a thud.

Georgia Karellas, a third-floor resident, said she heard a scuffle and a man yelling, “Please don’t. No, don’t do it!”�”� about 1:30 p.m. Friday.

Prosecutor Jeff Kendall said witnesses saw the fatal attack.

“They tried to intervene,”�”� Kendall told the judge in bond court.

Neighbors described the bloody scene they witnessed in the aftermath of the attack. They said Malone is retired and lived alone. He lived in the complex about 25 years.

Thompson, whose nickname is “Boo Boo,”�”� was named an All-American by multiple media publications his senior season in 1996-97 at Proviso West High School in Hillside. He was the top-rated defensive end prospect in the nation and the No. 7-rated player overall by The National Recruiting Advisor.

Thompson also won back-to-back state heavyweight wrestling titles in 1996 and 1997.

After high school, he went to Michigan State University but sat out his first two seasons. During the 1999 season, he was named the team’s most-improved player after recording 45 tackles and seven sacks.

Thompson declared for the NFL draft after that season and was signed by the New Orleans Saints' in April 2001. But he was cut after two days of practice after arguing with a teammate during a workout. A telephone message left with his brother late Friday was not returned.

The violence marked the village’s first homicide since Jan. 23, 2002, when Jennifer Lynn Klein was fatally shot in the head as she left a local tavern.

Police said the 24-year-old woman’s ex-boyfriend, Christopher Niezgoda, 25, killed her and then committed suicide minutes later at a nearby park.

Thompson reported earning about $10,000 last year. He is due to appear in court again April 30 before DuPage Circuit Judge Robert Anderson.

Got a personal story Gman hits home.~

Couple years ago a govt. subsidized welfare drug dealing prostitute moved in 3-4 houses down with 3-4 pickinannies. Never agreeing with mine playing with wild chimps, I let it go on. The oldest male of 12 years rode his bicycle without front tire, riding on the rim for several weeks. Finally, got a tire and tube, Tyronne asked me if I could install, which I did. Working out on driveway, without too much effort, I even aired it up. While doing so, the youngest but not the littlest, asked my oldest of 8 if he had a girlfriend. My ears couldn't beleive what I was hearing, but stayed silent. Approving my son to answer, he said "Yes, I have 3" Lil miss muffet asked "How bout making it 4"? Not able to bite my tongue any longer, I stepped in, speaking on a 6 yr. level, I attempted to explain we don't believe in mixing races, even dating, no matter how innocent this may be. All 3-4 went back home telling mommaboon's boyfriend what I had said, and it was no time, 4-5 was marching back down wanting to know what I had said. Repeating exactly to a 30+ year old at a 6 yr. old level, I included not believing in queer as well, trying to raise my two boys in Christian ways. Both are abominations unto the Lord. All left with heads drupping, starring at the ground as they left.

Couple weeks went by, I came driving up in our driveway, with both boys running down to greet me. As I'm hugging them, I'm seeing two full size coons doing the Montgomery march down the street toward me. We got nose to nose, she's screaming at her highest, "F-ing" this, "F-ing" that, "You F-ing whatever" an so on. Not knowing why she was so mad, I calmly asked her to refrain from speaking that kind of language in front of my young boys, which she did not. Telling her I'm calling the police, I did, asking the 911 they had better get these niggers off my property before I tie a rope around their necks. Police came and settled both houses. One officer said she said I told her I was going to burn a cross in her front yard. Explained to officer that was an outright lie. Reason being it's not described as a burning, but a Lighting, in which she will never have the honors seeing one, being the Africoon she is. Both officers smiled, as they learned something new that day.

Come to find out why she was so upset, was she thought we called the school on her, allowing her yardapes to skip school daily, in which a par officer earlier came out to investigate, writing her up. Never having any other disturbances, knowing what they can do, we never take our eyeballs off them, always watching each others backs. I took her butt to court, winning a protection order, that none of her household can step foot on my property ever again, which is grounds for trespassing and personal evasion, feeling threatened once before, I won't the second time.

Some good leasons learned to my two youngens~ Never trust a nigger!
